Request for Determination of Applicability (RDA) Filing Instructions

All required application materials must be submitted to the Conservation Commission at Halifax Town Hall.
  • An electronic copy of all required application materials must also be emailed to the Conservation Commission.
 
Step 1: Fill out the Request for Determination of Applicability (RDA) Permit Application WPA Form 1:
 
Step 2: Submit the Application and required materials to the Town of Halifax Conservation Department:  Plan your submission date based on the hearing schedule. 
 
  • RDA Application Submission Requirements:
    • RDA Application: (Must include).
      • Two (2) paper copies submitted to the Conservation Commission at Halifax Town Hall. 
      • Signed WPA Form 1 – RDA Application.
      • Two (2) separate Checks made out to the to the ‘Town of Halifax’ (see filing fees for amounts) https://www.halifax-ma.org/sites/g/files/vyhlif4496/f/uploads/local_filing_fees_0.pdf
        • One Check Town of Halifax” for RDA filing fee.
        • One Check to “Town of Halifax” for $45.00 for legal advertisement.
 
Step 3: You will be Given a Hearing Date and Time:
  • By submitting a complete RDA application (see items listed in Step 2), you will be scheduled to attend the next available public hearing.
  • Incomplete applications will not be accepted by the Conservation Office. 
  • The applicant or their representative must be present at the scheduled public hearing.
  
Step 4: Attend a Public Hearing:
  • Applicant/representative must present the proposed project to the board and answer questions.
 
Step 5: Receive additional Conditions: (If any are requested by the Board)
  • If you have any questions, contact the Conservation Department.
 
Step 6: Determination of Applicability (DOA): The Conservation Commission Office will provide a “Negative “or “Positive” Determination.
